Law Clinic - Trimester 1 2011/12 Interviews

Law Wise Law Clinic's first project: working with the Association of Scottish Community Councils (ASCC)

Furthermore, the partnership will allow for Community Councillors to submit questions online for studentadvisors to provide answers or referrals where necessary.

Induction Sessions

Trimester 1, 2011/2012

If you are interested in participating in the Law Wise Law Clinic in Trimester 1, 2011/2012, there will be an information session in enrolment week (week starting 19 September).

The interviews for the law clinic will be conducted towards the end of that week. The interview is conducted in a similar manner to a job interview – you are expected to attend in formal attire, and present an academic transcript as well as discuss why you are interested in participating in the law clinic.

If you are successful, you will be required to attend the law clinic on a weekly basis (e.g. a Monday afternoon from 1pm-4pm) as well as a morning session when you have case work/file notes to type up.

The law clinic is based at Renfrewshire Law Centre, opposite the Paisley campus on George Steet.

Law Wise Law Clinic seeks funding to continue for summer 2011

Law Wise is now into its second trimester with 22 student advisors. Unfortunately, due to a lack of funding available from UWS, Law Wise will be closing for the summer trimester unless we are able to secure funding from an alternative source.

Students of UWS participate in the drop-in advice surgery of RLC. The drop-in advice surgery is provided to clients in the Renfrewshire area who need legal advice. Since the law clinic was launched, student advisors participated in approximately 200 client interviews at drop-in advice surgeries. Students were exposed to a wide range of matters, the predominant matters being employment and housing issues. Other types of matters include debt, consumer advice, benefits and housing disrepair.

In addition to participating in client interviews, students also attended Paisley Sheriff Court to observe the law in practice. The students also visited the Employment Tribunal to give them an insight as to how employment matters are conducted.

The continuation of students from trimester 1 into trimester 2 has meant that some of our student advisors are able to take on casework on an ongoing basis. For example, the student teams have provided assistance in:

Consumer disputes leading to a small claims summons being lodged at Paisley Sheriff Court
Financial dispute leading to a complaint being lodged with the Financial Ombudsman Service
Property dispute as to the removal of trees from a property by a factor company
Drafting a minute for recall of decree in a debt matter
Researching the possibility of appeal to the Social Security Appeal Tribunal for a client whose application for Employment and Support Allowance was rejected
Property advice for a client whose property was flooded by a burst pipe in the roof while she was absent from the property
Employment advice to numerous clients who have been made redundant, unfairly dismissed, had their working arrangements changed, or who may have a claim for constructive dismissal
Property advice for a client whose factor wanted to make essential repairs to the property
Providing advice regarding consumer contracts
Consumer advice regarding car finance contracts and defective vehicles

A notable achievement of the law clinic is assisting a client who presented after being dismissed from his employment. The Monday law clinic team, under the supervision of Jon Kiddie (Principal Solicitor of RLC), provided assistance to the client which resulted in him being reinstated in his employment. This shows the real impact the work of the law clinic can have on its client’s lives.

There is a high demand in the Renfrewshire area for legal advice services. Where a client is not eligible for legal aid and cannot afford private legal fees, Law Wise is able to provide assistance under the supervision of a solicitor from RLC. As shown by the amount of clients seen in the first 8 months of the law clinic, Law Wise has become an invaluable service to the citizens of Renfrewshire.

Employment Tribunal visit - 29 March 2011

I have confirmed with the Employment Tribunal that we can attend on Tuesday 29 March 2011.

Places for the visit will be limited and you will need to commit to attending from 9.30am - 1.00pm.

The tour will include explaining the layout of the Tribunal room, where the parties sit, the function of the Tribunal and answer any questions observers may have. You may also request a copy of the Judgment.

Please note that I will confirm our visit with the tribunal on the Monday before, as cases are often settled at the last minute. Therefore, we may have to attend on a different date if there are no tribunals sitting on that day.

A reflection on the first trimester of Law Wise Law Clinic

Law Wise Law Clinic began in September 2010 and had its official launch on 15 October 2010. We were honoured to have Professor Seamus McDaid (Principal and Vice Chancellor of University of the West of Scotland) Hugh Henry MSP, Professor Donald Nicolson (Director of University of Strathclyde Law Clinic) and Mungo Bovey QC speak at the launch. The event was a huge success and it was really exciting to see how much enthusiasm and support Law Wise had at such an early stage.

We had 25 students apply to be a part of the law clinic and from this we selected 12 students to be the first student advisors. The students were selected by way of an interview with the Law Clinic Manager, Briony Cullin, the Academic Director, Dale McFadzean and UWS lecturer Stacey Lees. All 12 students have shown real eagerness and dedication to the law clinic. They received academic credit for their participation in the law clinic and have all committed to continuing with the law clinic as student advisors in Trimester 2 on a purely voluntary basis.

The student advisors were inducted into the law clinic by attending lectures on topics including office procedures, interviewing, letter writing and ethics. It is proposed that in the future, these induction lectures will be delivered by a one-day intensive induction into the law clinic which will also allow the students to be formally introduced to the law clinic base at Renfrewshire Law Centre (RLC), the staff of the law clinic and the staff of RLC.

Renfrewshire Law Centre holds a drop-in advice surgery for clients who need legal advice. This surgery is available Monday – Thursday afternoons. The student advisors sat-in on appointments with RLC solicitors to learn interviewing skills and technique, and over the trimester, students began conducting the interviews under supervision of the solicitor. In the period from September to December, student advisors participated in 108 client interviews at 34 drop-in advice surgeries. Students were exposed to a wide range of matters, the predominant matters being employment and housing issues.

In addition to participating in client interviews, students were also offered the option of attending the Paisley Sheriff Court to observe the Heritable Court, as well as attend legal conferences on various topics to encourage networking and understanding of a wide range of legal issues. More of these types of activities are planned for the future.

Law Wise Law Clinic is planning on inducting another 12 students in trimester 2 who will join the existing student advisor teams.

“Most of us don’t get the opportunity to talk to actual lawyers very often, especially not on an informal basis. This is not only valuable when it comes to legal knowledge or developing skills in that area, but also in respect to evaluating career choices and becoming aware of one’s prospects in the employment market. My group also particularly enjoyed sitting in at court proceedings. This is something we would have liked to do more often, especially if we could have observed an entire case from the beginning to end.”

An introduction to the student advisors of the Law Wise Law Clinic

Alistair Mair
I realised my keen interest in law during my studies in business management, especially in the areas of commercial and employment law. As a result I decided to pursue a career in the legal profession and I am currently a third year law student at UWS. Previously at UWS, I studied in the areas of Consumer Law, the Law of the European Union, Company Law and Liquidation, Commercial Law, Family Law and Personal Taxation. This year I am currently studying Private International Law and Legal Research Methods. I am looking forwards to studying Employment Law and the Law of Succession and will also undertake a Legal Research Project in preparation for my honours dissertation which I will complete in my 4th year. In addition, I am a student advisor within the Law Wise Law Clinic. On hearing about the exciting new project, I was keen to participate due to the valuable experience I could gain and my desire to help the general public, especially with regards to the law. On completion of my degree at UWS, I plan on undertaking an LLB course with the eventual aim of going into private practice.

Amanda Ferguson
I am an honours year law student at UWS. My dissertation topic will look at whether the UK should open up marriage to same sex couples, which is something I am very passionate about. In my final year I am also studying Contemporary Legal Issues, Advanced Criminal Law, and Administrative Law. I am excited to be a part of the Law Clinic in it's first year and I'm looking forward to all that I will experience.

Conrad Deasy
Year 4 (Level 10) BA (Hons) Arts of Law
In my current academic year I am undertaking, Contemporary Legal Issues, Advanced Criminal Law, and Administrative Law as well as being involved with the Law Wise Law Clinic and completing a dissertation in the area of Child Protection. In my previous years at UWS I have studied Family Law, Company Law and Liquidation, Business Law, Law of Evidence, Media Law, Legal Research Methods/Project, Landlord and Tenant, Law of Delict, Consumer Law, Scottish Criminal Law, Learning Scots Law, and Introductory Scots Law. Upon completing my degree at UWS I hope to go on and complete an LLB at another institution, preferably Strathclyde, and then go on to practice law in either the area of contract or family law. I wanted to be part of the Law Clinic to see how a solicitor works and because as a student I believe that practical experience is beneficial to the learning and understanding of how the law works.

Esana Ng
My name is Esana Ng and I am in my Honours year at the UWS. For my Honours dissertation I aim to research what constitutes to a legal and valid marriage and civil partnership in Scotland. As well as doing my dissertation this year I will also be studying Human Rights Law, Advanced Family Law, and also Administrative Law throughout the academic trimesters. Participating in the Law Clinic is an invaluable experience as it will allow students to view first hand the practical side to the Law aside from just the theory learned in lectures. It may also help students take the vital first step towards a career in practising Law.

Jade Brannan
Year 3 (Level 9) BA (Hons) Law

My interest in law is long standing; my decision to pursue a career in the legal profession was made in my early teens when I realised law seemed to suit my inquisitive and argumentative nature and my passion for justice. I am in my third year at UWS and, in addition to attending the Law Wise Law Clinic, I am currently undertaking Legal Research Methods, Law of Delict, Employment Law, Media Law and Law of Succession. In the previous academic years I studied Introductory Scots Law, Criminal Law, Public Law, Law and the Legal Process, Contract Law, Law of the European Union, Consumer Law, Property Law, Commercial Law, Family Law and Landlord and Tenant. Upon completion of the BA (Hons), my intention is to undertake the Bachelor of Laws and the Diploma in Legal Practice in order to work towards becoming a fully qualified solicitor. My passion for justice provoked me to apply to the Law Clinic and has afforded me invaluable practical experience in providing advice to clients.

Kayleigh Russell
My name is Kayleigh Russell, I am twenty-two years of age and I am currently a Law student at the University of the West of Scotland in Paisley. Modules I have successfully completed in my previous years include: Criminal Law, Contract Law, Family Law, Introduction to Scots Law, EU Law, Consumer Law, Property Law, Public Law, Commercial Law, Law and the Legal Process, and, Landlord and Tenant Law. This year I am studying Law of Delict, Legal Research Methods, Media Law, Information Technology Law, Legal Research Project along with attending the Law Wise Law Clinic. I was very keen on participating in the Law Clinic as I feel a person learns better by doing. It has been a wonderful experience for me and a privilege as it is the first year the University has ran this module. I feel like I have gained a lot from my experience working as a student advisor at the Law Centre and I look forward to continuing next semester. I have yet to decide my topic for my dissertation. However, I feel it may be in the area of Criminal Law or Media Law as I find both particularly interesting. It is Media Law that I am very keen on pursuing as a career, therefore, after I complete my Honors year next year I hope to continue studying Media at a Postgraduate level.

Kerry Burns
I'm a 4th year student at UWS studying BA Hons Law. The Modules I'm taking this year are Human Right Law, Advanced Criminal Law and Administrative Law along with the Law Clinic. I'm very interested in family law, criminal law and human rights law. I'm doing my dissertation on the historical development of the abortion laws.

Mashaal Baig
Since I can remember I have always wanted to help the public with their day-to-day problems and raise awareness of how Scots law can help resolve such issues. My main goal is to make a difference within society and make a positive impact. At the moment I am working my way towards this goal by completing my BA (Hons) degree in Law and I am currently in my final year at UWS. I have been able to gain an in depth understanding of many areas of law such as employment, succession, delict, family law, European law, constitutional and administrative law and also criminal law. My long term career aspiration is to become a paralegal specialising in family and employment law as these are the areas of law in which I am interested most. At the moment I am working part time at the Jobcentre as a Adviser Assistant and part of my role involves ensuring that claims to benefits are not made fraudulently. I really enjoy this aspect of my work and would also like to pursue a career as a fraud and compliance officer if I was given the opportunity to do so.

Saskia-Maria Schaarnowski
My name is Saskia-Maria Scharnowski, I am 20 years old and currently an Honors Law Student at the UWS. I have a particular interest in Contract and International Private law. Taking part in the Law Wise Clinic is an exiting opportunity for me to gain valuable skills and experience law in practice. In future I would also like to work in the legal field and hope to become a solicitor.

Year 4 – BA (Hons) Law
I intend to pursue a career in the legal profession and so once I have completed my honours law degree at UWS, I am going to do the fast-track LLB at another university followed by the LPC. It has always been my goal to practice as a solicitor in the legal sector. I wanted to be involved with the law clinic because it’s a rare and unique opportunity available for a law student to be part of, and the experience that one would receive in the end would not only prove beneficial and valuable for their legal studies but it will act as a useful preparation tool in a legal profession. Hence, it gives a law student a new perspective in a legal career as it will intellectually test the law student to put the theoretical aspects of law into practical use.

The Equality and Human Rights Commission, LGBT Youth Scotland and the Equality Network invite you to join a specially convened symposium to discuss

EQUAL MARRIAGE

As the law stands, same sex couples in the UK can enter into civil partnerships, but marriage is not yet an option.

The law also interferes with both marriage and civil partnership rights of transgender people.

This event will investigate the perceived barriers to equal marriage and seek to produce a roadmap for legislators as to how to make equal marriage a reality, suggest areas for further consideration and make recommendations for moving forward.

More information about the Law Wise Law Clinic

The Law Wise Law Clinic will be available to disadvantaged persons to attend and obtain legal advice. Student advisors from the University of the West of Scotland will work under supervision to provide written legal advice and assistance in respect of a wide range of matters. There is a real need in the Renfrewshire and Greater Glasgow area for advice services to assist disadvantaged persons who may be unable to receive legal assistance elsewhere. Law Wise is intended to be complementary to the legal services which are already provided by solicitors and other agencies. It therefore does not act for anyone who can afford the use of professional legal services or qualifies for legal aid.

UWS students will participate in the law clinic through the module Law Clinic - Work Based Learning and therefore will receive academic credit for successfully completing the law clinic.
